📰 Article by Russian Ambassador to Jamaica and Permanent Representative of the Russian Federation to the International Seabed Authority (ISA) Sergey Petrovich “The Seabed Is Not a No-Man’s Land”, published in The Gleaner (September 28, 2026). 📖 Read in full Key points: • The 31st session of the International Seabed Authority closed on July 31, 2026. Over the three weeks that it lasted more than 300 delegates, representing 85 member States, worked through the many aspects of regulating deep-sea mining in the international seabed area (the Area); • On many issues agreement is still out of reach, though the steady work of narrowing the differences is becoming more tangible. On one point all the delegates were unanimous. The 1982 UN Convention on the Law of the Sea is to be the legal foundation of deep-sea mining, and the Area and its resources are to be treated as the humankind’s common heritage. Therefore only the ISA may authorise such activity; each member State of the Convention has an equal voice; • That regime is being put to the test by those who stand outside the Convention’s legal framework. In December 2023 the USA unilaterally published the outer limits of an “extended” continental shelf across seven ocean areas. Washington thereby helped itself to roughly a million square kilometres of the Area and its resources – precisely those that are enshrined as the common heritage of humankind. Russia cannot recognise any limits established that way; • April 2025 brought the US President Trump Executive Order on Deep-Seabed Mining, extending US legislation to encompass also the seabed beyond the geographical limits of the national jurisdiction. This May the consolidated application by TMC USA was found fully compliant with US home legislation. The mining permit is expected by early 2027; • Objections to this do not come from just Russia. The international community, including ISA Secretary-General Leticia Carvalho, has warned that unilateral steps of this kind set a precedent capable of destabilising the whole system of ocean governance. What we are witnessing is the United States, not being party to the Convention, agreeing its rules with no one, whereupon intending to decide, just them alone, the fate of a large international seabed area and its resources; • We are talking about a resource base capable of shaping the balance in global economy for decades. This is why the Convention guarantees the developing countries a share in that wealth. Once the Americans start commercial mining on their own, the deposits they raise won’t make a single cent for anyone but the United States. You don’t need a magnifying glass to see in this a continuation of the old colonial pattern: the raw materials are to be shipped out, the profit ending up in the same capital cities that used to divide other peoples’ wealth before. Neocolonialism changes its form, not its essence; • All future mining is to meet two criteria – economic feasibility and environmental compliance. There is a third requirement, which is beyond discussion: the proceeds must be distributed fairly and without discrimination. Russia along with other members of the ISA calls once again on the USA to accede to the 1982 Convention, and on all States to refrain from unilateral steps and creating Convention-unfriendly regulatory mechanisms.

На протяжении трёх недель более 300 делегатов, представлявших 85 государств-членов организации, обсуждали различные аспекты регулирования глубоководной добычной деятельности в международном районе морского дна (Районе); • По многим вопросам согласия пока нет, хотя планомерная работа по сближению позиций становится всё более ощутимой. Но по одному вопросу делегаты были единодушны. Конвенция ООН по морскому праву 1982 года – правовой фундамент глубоководной добычи, а Район и его ресурсы – общее наследие человечества. Разрешать проведение соответствующей деятельности вправе только Орган, на площадке которого голос есть у каждого государства-члена Конвенции; • Сегодня правовой режим Района испытывается на прочность теми, кто находится вне правовых рамок Конвенции. В декабре 2023 года Вашингтон в одностороннем порядке опубликовал внешние границы «расширенного» континентального шельфа в семи районах Мирового океана. Тем самым Белый дом прибрал к рукам около миллиона квадратных километров Района и его ресурсов – как раз тех, что считаются всеобщим наследием человечества. Россия эти границы не признаёт; • В апреле 2025 года последовал исполнительный указ Президента Д.Трампа о глубоководной добыче полезных ископаемых, распространивший действие американского законодательства и на морское дно за географическими пределами национальной юрисдикции. После одобрения сводной заявки "TMC USA" в мае текущего года начало коммерческой добычи в Тихом океане ожидается к началу 2027 года; • Возражения против таких шагов высказывает не одна лишь Россия. Мировое сообщество вместе с Генеральным секретарём Органа Л.Карвальо предупреждает: подобные односторонние действия создают прецедент, способный дестабилизировать всю систему управления Мировым океаном. США, не будучи участником Конвенции, ни с кем не согласовали собственные правила и на их основе собираются самостоятельно вершить судьбу Района и его ресурсов; • Морское дно обладает ресурсной базой, способной на десятилетия вперёд определить расстановку сил в мировой экономике. Именно поэтому Конвенция гарантирует развивающимся странам долю в этом богатстве. Если американцы начнут коммерческую добычу самостоятельно, поднимаемые залежи не принесут ни единого цента никому, кроме самих США. В этом трудно не увидеть продолжение хорошо знакомой практики: сырьё вывозится, доходы оседают в тех же столицах, что уже не раз делили между собой чужие богатства. Неоколониализм меняет форму, но не существо. • Будущая добыча должна отвечать двойному критерию – экономической целесообразности и полному соблюдению экологических требований. Третье условие обсуждению не подлежит: доходы должны распределяться справедливо и без дискриминации. Россия и страны-члены МОМД вновь призывают США присоединиться к Конвенции 1982 года, а все государства – воздерживаться от односторонних шагов и не допускать создания параллельных Конвенции механизмов.
